BAYAR Pay Inc. is a financial technology company providing a global peer-to-peer payment app built on the Solana blockchain. Our service allows users to send and receive payments in USDC (a regulated digital dollar) using only a phone number or QR code.

BAYAR Pay Inc. acts as the Data Controller for personal data processed through the BAYAR app.

2. What Information We Collect

When you use BAYAR, we may collect the following information:

  • Account Information: Your phone number, chosen authentication method, and security PIN.

  • Transaction Information: Details of payments you send or receive (amount, timestamp, wallet address).

  • Technical Information: Device type, operating system, IP address, and usage data for performance and fraud prevention.

  • On/Off-Ramp Information: When you buy or sell USDC using our partner OnRamper, their KYC/AML processes apply. We do not see or store your ID documents, but may receive confirmation of verification.

We do not collect or store your private wallet keys or funds. You remain in full control of your assets at all times.

3. What We Don’t Collect

  • We do not request or store government-issued identification or personal documents, except when required by OnRamper for fiat conversion.

  • We do not sell, rent, or monetize your personal data through advertising or third-party data sharing.

  • We do not have access to your private keys; only you can unlock your wallet with your personal PIN.

4. How We Use Your Information

We process your personal data only as necessary to:

  • Securing and providing access to your account.

  • Processing transactions securely via the Solana blockchain.

  • Protecting against fraud, abuse, and money laundering.

  • Complying with legal obligations.

  • Improving and optimizing the BAYAR app experience.

5. Legal Basis for Processing (GDPR)

Under GDPR, we rely on the following legal bases for processing your data:

  • Contract performance: To deliver our payment services.

  • Legal obligation: To comply with anti-money laundering and fraud prevention rules.

  • Consent: When you choose optional services.

  • With OnRamper, for KYC and fiat on/off-ramp transactions.

BAYAR operates globally. By using our services, you acknowledge that your data may be transferred to and processed in jurisdictions outside your country of residence. We ensure appropriate safeguards are in place to protect your data in compliance with applicable law.

12. Children’s Privacy

BAYAR is not intended for individuals under 18 years of age. We do not knowingly collect information from children. If we discover that a child has registered without consent, we will take steps to delete that information immediately.

13. Right to Erasure (Account Deletion and Data Removal)

In accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and U.S. state privacy laws such as the California Consumer Privacy Act (CCPA/CPRA), you have the right to request deletion of your account and associated personal data.

Required Information

To enable us to identify and process your request, please include the phone number associated with your BAYAR account.

Verification and Processing

  • Identity Verification
    To protect your personal data and prevent unauthorized requests, we must verify your identity before proceeding. Verification may be carried out via the phone number registered to your account, including by SMS or phone call.

  • Processing Timeline
    Following successful verification, your account and personal data will be deleted from our active systems without undue delay and no later than 30 days from verification, unless a shorter period is required by law.

  • Legal Data Retention
    Please note that we may retain certain information where required to do so by applicable laws or regulations. This may include, but is not limited to, transaction records, compliance-related data, tax documentation, and audit logs. Any retained data will be securely stored and processed solely for the purposes required by law and for no longer than legally necessary.

Effect of Deletion

Once your account is deleted:

  • You will no longer be able to access your BAYAR account.

  • Remaining balances must be withdrawn prior to deletion, where applicable.

  • Deleted data cannot be recovered.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When changes are made, we will update the “Effective Date” at the top of this page. Significant changes will be communicated to users through the app or via email.

15. Disclaimer & Liability

BAYAR provides its services “as is” and without warranties of any kind, whether express or implied. While we take all reasonable steps to ensure the security and reliability of our platform, we cannot guarantee uninterrupted, error-free, or fully secure operation at all times.

You are solely responsible for:

  • Safeguarding your authentication credentials, including your PIN.

  • Ensuring that your transactions are accurate before confirmation (all BAYAR transfers are final and irreversible).

  • Maintaining control of your device and phone number linked to your BAYAR account.

BAYAR Pay Inc. is not liable for:

  • Any losses arising from unauthorized access to your account caused by negligence in protecting your PIN, phone, or authentication method.

  • Loss of funds due to blockchain network errors, outages, or external third-party service failures (e.g., OnRamper).

  • Fluctuations in exchange rates or value of USDC outside our control.

  • Indirect, incidental, or consequential damages, including loss of profits, business, or data.

By using BAYAR, you acknowledge that responsibility for securing your wallet and device rests with you, and you agree that BAYAR Pay Inc. is not responsible for losses outside of our direct control.
